Dalcon makes no warranties or representations as to its accuracy and Dalcon specifically disclaims any liability or responsibility for any errors or omissions in the content on the Site. Neither Dalcon nor any other party involved in creating, producing, or delivering the Site is liable for any direct, incidental, consequential, indirect, or punitive damages arising out of your access to, or use of, or inability to use or access, the Site whether due to a breach of contract, breach of warranty, negligence, or otherwise..

Features and specifications of products described or depicted on the Site, or available for purchase through the Site, including, without limitation, prices of products or services displayed on the Site and delivery or other charges are subject to change at any time without notice. All monitor screens are measured diagonally; all monitor screen images contained in this database are simulated pictures unless otherwise indicated.

Dalcon assumes no responsibility, and shall not be liable for, any damages to, or viruses that may infect, your computer equipment or other property on account of your access to, use of, or browsing in the Site or your downloading of any materials, data, text, images, video, or audio from the Site. Dalcon also assumes no responsibility, and shall not be liable for any interruptions or errors in access to the Site or the accuracy, timeliness, completeness, security or reliability of any communications (including, without limitation, any transactions) made through or in relation to the Site.

If you send any communications or materials to the Site by electronic mail or otherwise, including any data, questions, comments, suggestions, or the like, all such communications are, and will be treated as, non-confidential and non-proprietary. 5. The Site refers to products and/or services that are generally available for purchase in Australia but may not be available in your particular country or locality. The reference to any such products or services in this Site does not imply or warrant that these products or services will be available at any time in your particular locality. You should therefore check with Dalcon for specific product/service availability in your locality.
6. Dalcon is not responsible for the content of any site linked to or from the Site. Your linking to any other site is entirely at your own risk. While Dalcon may provide links on this Site to other sites, the inclusion of such links is for your convenience only and should not be interpreted as an endorsement of the owner/sponsor of the site or the content of the site. Dalcon disclaims all warranties, express and implied, as to the accuracy, validity, legality or otherwise of any materials or information contained on such sites.

Although Dalcon may from time to time monitor or review discussions, chats, postings, transmissions, bulletin boards and the like on the Site, Dalcon is under no obligation to do so and assumes no responsibility or liability arising from the contents of any such communications nor for any error, defamation, libel, obscenity, profanity, or inaccuracy contained in any such communication. You are prohibited from posting or transmitting any unlawful, threatening, defamatory, libellous, obscene, pornographic or profane material or any material that could constitute or encourage conduct that would be considered a criminal offence or give rise to civil liability, or otherwise violate any law. Dalcon will fully cooperate with any law enforcement authorities or court order requesting or directing Dalcon to disclose the identity of anyone posting such materials. 8. Any order placed by you on the Site is an offer by you to purchase the particular product or service specified. Dalcon reserves the right to accept or reject your offer for any reason, including, without limitation, and error in your order or in the material on the Site, or the unavailability of the product or service. The contract to purchase the particular product or service only comes into existence in accordance with the Terms and Conditions of Sale of that product or service.
9. Dalcon may at any time revise these Terms and Conditions by updating this posting. Since you are bound by these Terms and conditions, you should therefore periodically visit this page, by clicking the Terms and Conditions hyperlink at the bottom of the Dalcon web pages, to review the then current Terms and Conditions.
10. Dalcon may terminate this agreement and your access to the Site at any time without notice. In the event of termination, you are no longer authorised to access the Site, but any and all restrictions imposed on you under these Terms and Conditions, and licences granted to Dalcon, and any Dalcon disclaimers and limitations of liability will survive such termination.
11. The copyright in this website is owned by Dalcon. No part of parts hereof may be reproduced, distributed, republished, displayed, broadcast, hyperlinked or transmitted in any manner or by any means or stored in an information retrieval system without the prior permission of Dalcon. You also may not, without Dalcon's permission, "mirror" any material contained on this website on any other server.

Ordering

1. Dalcon only sells and ships Products within Australia.
2. If you would like product, pricing and stock information, our sales team are available to assist you Monday to Friday, 9am to 5pm, on (08) 9271 6200. For order status information on orders made online, please check your account page, or alternatively, contact our sales team.
3. You may place your order by either;
   1. Ordering online using the Dalcon Online Store.
   2. Faxing a purchase order to (08) 9248 9120
   3. Over the Phone to one of our sales team on (08) 9271 6200 between 9am and 5pm, Monday to Friday (excluding public holidays).
4. By placing an Order, you make an offer to us to purchase the Products you have selected on these terms and conditions. We may or may not accept your offer at our discretion. If you have ordered online using the Dalcon Online Store, we will notify you of your order confirmation by email or phone.
5. Orders made on weekends will not begin the Order process until the Next Business Day.
6. Products sold by Dalcon will include GST. Orders made online are quoted in GST inclusive prices.

Payment

1. Whether you order online, fax, or phone, Dalcon will allow you to make payments as described below;
   1. Payment by EFTPOS, Visa and MasterCard credit or debit cards
   2. Dalcon will accept direct deposit as payment for an order. Please reference your company and/or name, as well as the order number when making payment to:

   3. Dalcon will only accept cheques with prior arrangement made with our accounting team. You can contact our accounting team on (08) 9271 6200 between 9am and 5pm, Monday to Friday (except Public Holidays). Please make cheques payable to Dalcon Computers Pty Ltd. 2. Unless you have an account with Dalcon, you must arrange for payment for your order prior to Dalcon shipping your order to you. If payment is has not been received within 10 business days, Dalcon will cancel your order, unless prior arrangement have been made.
3. Dalcon reserves the right to hold orders that have not had payment arrangements met, or, if you are an account holder, you are placed on credit hold.
4. An invoice will be supplied with your order, or you may request and invoice to be emailed to you.

Shipping: Delivery or Pick-up

1. Dalcon will charge you for shipping of your product. If you have ordered online, shipping charges will be shown in the order Cart. Dalcon, at it's discretion, may waive some, or all, shipping charges on an order.
2. You may wish to collect your order from Dalcon in person, if you wish to do so, shipping charges will be waived. Please contact our sales team on (08) 9271 6200 between Monday and Friday (except Pubilc Holidays) to arrange for pick up.
3. Dalcon will supply you with the Products as indicated on your order. If any product that you have ordered cannot be supplied, Dalcon will contact you with an offer of an alternative product, or cancellation of that product from the order.
4. Products on a single order will be shipped as a whole once all the Products on that order are available. If you wish to part ship your order, as Products become available, please instruct us to do so by either leaving a comment on your online order, or contact our sales team on (08) 9271 6200 between 9am and 5pm, Monday to Friday (excluding public holidays).
5. Estimated shipping time includes time required to validate your order, payment arrangements, package your order, and in some cases, assembly. Dalcon endeavours to ship your order within the shipping time provided. The estimated shipping times are in Business Days and exludeds weekends and public holidays. Although every effort will be made to ship your order within the estimated shipping times, shipping times may change due to changes in supply. If delays occur, Dalcon will contact you with a revised shipping time.

Returns

If you are not satisfied with your purchase, please call our accounts team on (08) 9271 6200 between 9am and 5pm, Monday to Friday (excluding public holidays) to arrange for a Return Material Authorisation (RMA) within 14 calendar days of the receipt of the product(s).

Please note Dalcon reserves the right to refuse the return of, or offer refunds for the following products;

1. Opened memory
2. Opened software
3. Opened products that are return in a non re-saleable condition (i.e. missing manuals, discs, cables, and/or packaging).

Dead on Arrival (DOA) Products

Products concidered DOA if it shows sypmtoms of hardware failure, preventing basic operability, upon first use out of the box. If you believe your product(s) are DOA, please call the Dalcon support team on (08) 9271 6200 between 9am and 5pm, Monday to Friday (excluding public holidays) within 7 calendar days of receipt of the product(s). The Dalcon support team will determine whether the product is DOA and offer you the following options:

1. Replacement: The same product(s) that you ordered will be shipped to you at Dalcon's expense. The product must be deemed DOA by the Dalcon Support team within 7 calendar days of receipt to be eligible for replacement.
2. Service: You may have the product(s) repaired; however, once serviced, the product(s) is no longer eligible for replacement
